Terms of Use - Creator
Hi there, we are CG Cookie, the team behind the Blender Market. We may refer to ourselves as ‘CGC’, ‘we’, or ‘us” below and are excited that you are interested in becoming a creator! When we say ‘you’, we mean creator.
If you are here, you may already be intrigued with the idea of possibly earning passive income, working on items you want to work on, and having the opportunity to help grow the professional Blender toolset and resources.
Becoming a Creator:
Before you take on this adventure, there are few things to keep in mind and responsibilities that you will be responsible for, so as to remain a positive, active creator on this website. We take this very seriously, and so should you.
As a Blender Market creator, we require you to follow certain guidelines before a product can be published and/or remain on the marketplace. Please review the following requirements and responsibilities before proceeding to become part of the marketplace:
- All items must be of your own creation. If you are using products not created by you, you must have adequate licensing that allows for the sale and redistribution of those products.
- Supply accurate personal contact information. You may review the manner in which we use this information in our Privacy Policy.
- You must have a valid PayPal account to receive payments.
- You must follow all requirements listed in the General Product Guidelines.
- You must offer a reasonable level of support for your product(s). Products that we find to be inadequately supported may be subject to removal/termination from Blender Market.
- You must be at least 16 years old.
- You must have a registered Blender Market account.
- You must ensure that your product does not contain any malicious software, viruses, or code designed to cause harm to computers, software or persons using the item.
- You must ensure that your product does not infringe on any third-party rights (e.g., copyright, trademark, rights of publicity, etc.)
Please understand that becoming a creator does not imply any sort of joint-venture, employment or legal partnership between you and CG Cookie, Inc.
Becoming a creator means you agree to abide by the Creator Policy.
How Selling Works:
Payments and Earning Money
Blender Market is the Merchant of Record. We handle all transactions and payment collection for the products you list, then pay you earnings based on those sales for your creative work, development, maintenance and product support.
Getting paid is important, of course, and a key part of being a creator. Below is information outlining how you will be paid, what you’re responsible for, and what CGC is responsible for.
Distribution of Commissions
To help fight fraud, payments are held for up to 31 days before processing. This creates a safety net for both Blender Market and you in the event of fraudulent purchases. This means that your first payment will be distributed within 31 days from the date of first sale on Blender Market, with subsequent payments following on the first business day of each month thereafter, provided your accrued earnings meet the minimum payout threshold.
Remittance of payments is processed on the first business day of the month. If the 1st of the month falls on a weekend, remittance of payments will be sent out the next business day. If the 1st of the month happens to fall on a US holiday, remittance of payments will be sent the next business day.
Remittance of payments will be sent via PayPal.
Dealing with Fraud and Customer Refunds
CGC puts up reasonable security and fraud-checking measures to prevent fraudulent transactions. However, as is the case with Internet transactions, no one is totally immune from fraudulent transactions. If a fraudulent transaction occurs in connection with your product(s), you will be notified as soon as CGC becomes aware of such fraudulent transaction. A refund will be issued for such fraudulent transaction and any commissions removed. This means that if commissions have not yet been paid, the commission amount of the fraudulent transaction will be removed from your projected payout. If commissions have already been paid in connection with the fraudulent transaction, CGC will deduct the amount of the paid commission in connection with such fraudulent transaction from future commissions earned, until CGC is fully reimbursed for the payment of such commission.
The reason for the commission deduction is that fraudulent purchases are made with stolen credit cards and/or accounts, and so the purchase is refunded back to the rightful owner, whom was not responsible for the fraudulent transaction.
Donations to the Blender Development Fund
As a creator you will have the option to donate a portion of your earnings to the Blender Development Fund; your donation(s) are facilitated by CGC. By donating a part of your earnings, you are agreeing to allow CGC to donate a percentage of your profits to the Blender Development Fund. The amount donated is chosen by you, the creator, at the time of product submission. This amount may be changed by you at any time on a per-product basis.
CGC will make a monthly, lump-sum donation to the Blender Development Fund and will provide a breakdown report to the Blender Foundation with the names of creators who have contributed.
Exclusivity
We do not maintain any exclusivity policy. You are free to sell your products on any other marketplaces or through any other manner you choose.
Licenses
By selling your product(s), you retain your copyright while allowing others to copy, distribute, and make use of your product according to the license you've chosen for your product(s).
Discounts, Sales, and Negotiated Deals
CG Cookie reserves the right to offer select discounts to customers in order to promote and grow the marketplace as a whole. When these discounts are used, the earnings for all parties (the Creator, CG Cookie, Collaborators, Dev-Fund contributions) will be reduced equally based on the size of the discount.
Additionally, from time to time CG Cookie may offer sales or negotiated deals on Blender Market. In order for us to make this possible, you give us permission to negotiate these deals. You will be informed via email when this happens and have the chance to opt-out your product(s) within a defined timeframe. If you do not respond, your product will be included within the sale or custom deal on Blender Market.
Due to the nature of sales and negotiated deals, your earnings amount may differ depending on the details of the sale or negotiated deal.
Review Copies
On occasion, we may be asked for review copies of your product(s). You allow us to send copies of your products to any reviewer, as we see fit. These copies are meant solely for review purposes by those reviewers to whom we send them. You additionally accept that we do not have control over the outcome of these reviews. Receiving a negative review is possible. We will also email you when a review copy is sent out.
If you would explicitly not like your product to be reviewed by a third party, please let us know at [email protected] at the time of creator registration.
Acceptance of Products
Each product will be reviewed before it is accepted into the marketplace. We reserve the right, in our sole discretion, to refuse a product submission for any reason.
Things You Agree to Do As a Creator on Blender Market:
Think of your product(s) and your profile page as your business, storefront, and/or gateway to customers. To ensure a successful business with happy customers, you are responsible for the following:
- You have the intellectual property rights to sell products and are not infringing on any third party rights (e.g., copyrights, patents, trademarks, rights of publicity, etc.).
- You’ve selected the appropriate license for your product.
- You do not offer a false or misleading presentation of what the product is.
- Your product is free of viruses or malicious code that could do harm.
- Your product has followed any and all creator guidelines that we have set in place.
Product Support
As a creator, you are responsible for providing “adequate and reasonable support” to all of your customers in connection with all of the products you upload to Blender Market. “Adequate and reasonable support” is defined as doing your best to answer each customer’s questions, solve problems that a customer may have with the product, and/or otherwise work towards resolving any issues that arise with the product.
Customer support of your product(s) is handled via your Inbox on Blender Market.
How We May Use Your Product:
CGCookie may use your product(s) in relation to marketing and promotion of Blender Market. We do not make any claim of your product and/or transfer of any intellectual property right. You retain complete right, title, and interest in and to your product.
By uploading products to Blender Market, you agree to allow us to use the product as described above.
